Hudson The recent cool mornings are a harsh reminder to those of us who would rather live some place perpetually warm, that the good times of summer will soon end. I usually transition as slowly as possible into the winter mode - first adding long sleeves and then a sweat shirt, but I hang on to the shorts as long as possible. By doing this I can usually kid myself that it's still summer until sometime in mid-November. This year the candidates for governor are making it hard for me to maintain my illusion. The mudslinging in advance of the November elections has hit warp speed. If half of what each candidate claimed about the other was true, Virginians would be in terrible trouble. I am happy to report that the PWC Bar did its part in October to educate local voters about the true qualifications of our candidates for the House of Delegates. The candidates' forum went off smoothly and even garnered some TV coverage on News Channel 8. While direct answers were in somewhat short supply, I think the candidates were open and honest about their positions on the issues. Happily, there was little or no mudslinging. All of the candidates expressed their appreciation to the Bar for providing an opportunity to explain their views to their constituents. Thank you to all who volunteered to help with this event. As many of you know, November is pro bono recognition month. An attorney (not, to my knowledge, a member of our Association) remarked to me recently that he does plenty of pro bono work and feels no need to do more because "there are lots of clients that don't pay my bills". I empathize with our colleague, and goodness knows that if I had all the fees I've written off over the years, I could pay for both my kids' college. I'm sorry to say, however, that deadbeat clients don't count. Pro bono is not synonymous with being taken advantage of.  By definition it involves doing something for the public good. I know there are many members of our Bar that give their time to the community through churches, civic organizations like Kiwanis, and aid organizations such as SERVE. These efforts are typically anonymous and often unappreciated, but they do much to help our fellow citizens and to improve the image of our profession. Our pro bono committee has worked diligently for as long as I can remember to identify and meet the legal needs of the less fortunate members of our community. Many of you have helped with the pro bono divorce project which is now in its fifth year. We have this year launched a pro bono wills project to provide wills free of charge to those with modest means. The committee has also been exploring how we might help other volunteer organizations by removing legal barriers they may encounter from time to time. Sievers, Chief Judge The court wants to emphasize (again) to the court appointed attorneys that their time sheets must be timely filed and complete.  Since this was last mentioned, the sheets have been coming in within tolerable time frames (mostly at the time of disposition of the case which is the most preferable way to do it), but we continue to receive them when they are incomplete- mostly regarding the hours and the total in dollars.  If incomplete time sheets are sent to the state for payment, they will come back for completion.  This just adds time to the receipt of the payment for those services, so it is in the best interests of the attorney to file it correctly and completely the first time. The court appreciates the fine work of all the court appointed attorneys, and wants to get them paid (as little as it may be) as soon as possible.  Thank you for your cooperation. J&DR Docket Update From Frances Hedrick, Clerk of the J&DR District Court Attached is a copy of the J&DR District Court docket effective December 1, 2005. There are a couple of changes to the schedule, but the ones that may effect members of the PWC Bar the most are as follows: DSS docket:  Currently the DSS docket starts at 2:00 p.m. each day of the week. Effective December 1st, 2005 the docket will begin at 1:30 p.m. DCSE court schedule:  The 1st week of each month DCSE contested cases will be set in the "CC docket".  The DCSE schedule will remain the same for the 2nd, 3rd, and 4th week of each month. Ex-parte hearings:  These were previously heard in courtroom #4, and will now be heard in courtroom #2 at 1:30 pm. J&DR Timesavers The executive board of the bar has commissioned an ad hoc committee to develop a J&DR Timesavers Guideline, similar to those currently in use for Circuit and General District Court.  The following have agreed to serve on the committee:  Chairman: Mike Phipps.  Committee members:   Judge Gluchowski, Scott Bailey, Rusty Von Keller, Pat Hammond, & Nancy Stone.  An initial meeting will be scheduled in the next couple of weeks with the hopes of completing this project in early 2006.  If any members of the bar have suggestions or topics they would like to have included, they should contact Mike Phipps at 703-792-6050, or any member of this committee as soon as possible. President's Message, Continued As it turned out, most of their problems were pretty simple, but to a non-lawyer, they were a source of great concern. In future months I would like for us to broaden our outreach to the community by interfacing with other organizations to help smooth the way for their good works. We as lawyers may not be able to heal the sick or house the homeless, but we should whenever possible help those who can. Our November luncheon meeting will feature Judge Gerald Bruce Lee of the U. S. District Court for the Eastern District of Virginia. To accommodate Judge Lee's schedule we have moved the meeting to THURSDAY, November 3 at 12:30. Please mark you calendars and don't forget the day change. Anyone who shows up on Friday will find all the food gone. Litigation Update By J. Scott Krein This summer the Supreme Court approved an amendment to the Rules of Professional Conduct relating to, essentially adopting the American Bar Association's Model Rule on general conflicts.  New Rule 1.7 is included in the copy of the current Rules of Professional Conduct that were mailed with the October Virginia Lawyer.  If you did not receive your copy, you can review it at http://www.courts.state.va.us/scv/ame ndments/06_30_05_rule_change_1_7. pdf . Decisions on jurisdiction under the Virginia long arm statute continue to be interesting.  If there is any area where the particular facts make all the difference the "single act" jurisdictional analysis has to be a strong contender for the top spot.  Any quick Shepardizing of Nan Ya Plastics Corp. United States v. DeSantis, 237 Va. 255, 377 S.E.2d 388, cert. denied 492 U.S. 921, 109 S. Ct. 3248, 106 L. Ed. 2d 594 (1989) will yield more than enough reading.  Particularly with subsection B's provision that "[u]sing a computer or computer network located in the Commonwealth shall constitute an act in the Commonwealth", the "internet jurisdiction" decisions are particularly interesting.  Close to home, thi s summer the Fairfax Circuit Court issued a decision concerning an eBay transaction that may or may not surprise you.  See, Irving v. Wagner Zone, Inc. , No. CL2004-227003, 2005 Va. Cir. LEXIS 116 (June 6, 2005)(dismissing for lack of personal jurisdiction causes of action under the Virginia Consumer Protection Act, Breach of Warranty, Breach of Contract, and a Virginia statutory warranty disclosure statute against Illinois corporation's sale of car through eBay to Virginia seller specifically holding the contract was "not consummated in Virginia" and, applying the Virginia commercial code statutes regarding auctions, noting "Defendant stipulated on the auction website that local pick-up in Illinois was required."). THANK YOU!  FROM LEGAL SERVICES OF NORTHERN VIRGINIA By Naznin Saifi, Managing Attorney, Prince William Office It has been five (5) years since the Pro Bono Committee of the Prince William County Bar Association and Legal Services of Northern Virginia began the Uncontested Divorce Project.  During that time, Allen Newcomb, Esquire, headed the Project, which assists low income residents of Prince William County, Manassas and Manassas Park in obtaining a divorce.  This year, Allen has stepped down as the head of the Project in order to devote his full attention to the Bar Foundation.  I would like to take this opportunity to thank Allen for his commitment and the time that he devoted to this Project.  It is in many ways due to Allen that the Project has been such a success. I, along with LSNV, would also like to take this opportunity to thank the number of Pro Bono attorneys that have assisted those eligible individuals in obtaining an uncontested divorce.  Without the continued support of the Bar and its members, LSNV would not be able to offer this service to our client community.  Editors' Note: The attorney volunteers supporting the UCD project from September 2004 to October 2005 are listed here. Wheeler Another organization that has been integral to the success of the Uncontested Divorce Project has been the Prince William County Association of Legal Professionals.  Each month, the Association provides assistance to the individuals who come to our office seeking a divorce; they assist them with completing the general information questionnaire and the pleadings necessary to file the divorce.  This past year the Association and the Bar both received recognition for their work and dedication to this Project from the Virginia Association of Legal Professionals. Finally, I would like to thank Elizabeth Munroe Von Keller, Barbara Murphy Stough, Gerald Baker, Tracy Hudson and Richard Wheeler, who have participated in the pilot for the Simple Wills Project.  Through this Project, the Pro Bono Committee and LSNV hope to assist the low income elderly residents of Prince William County in obtaining a simple will. Commission on Virginia Courts in the 21st Century Sharon Pandak has been appointed by Chief Justice of the Virginia Supreme Court, Leroy Roundtree Hassell, Sr., to serve on the Commission on Virginia Courts in the 21st Century:  To Benefit All, To Exclude None .  The Commission, chaired by Anne Marie Whittemore of McGuire Woods, will study the future of Virginia's judicial system. The Commission will be supported by Five Task Forces covering Technology & Science; Other Judicial Functions; Structure of the Judicial System; Judicial Administration; and Public and the Courts.  Pandak will serve on the "Other Judicial Functions" Task Force, and is assigned to a subcommittee studying the concept of substitute judges.  She asks that members of the PWC Bar having experience with substitute judges, or ideas about the use of substitute judges contact her with their ideas.                                                                  -3-

She was terrified to be in the same room with her ex-fiance.  Pro bono representation allowed her to confront her fears in the courtroom.  The woman also had a problem with a debt on the respondent's car loan.  Although the loan was in the woman's name, the car belonged to the respondent and he wasn't making payments.  He wouldn't speak to anyone else about taking her name off the loan. While the additional assistance wasn't required or expected by the pro bono agreement the information offered by the attorney was quite beneficial. What is not always apparent is the control some people exert over another.  Without meaning to, the community often minimizes or even dismisses the need for safety amidst the chaos (your spouse has been under a lot of pressure, you don't want your spouse to lose his/her job, or you shouldn't have pushed his/her buttons).  But, these attorneys are supportive and for at least one afternoon they even the playing field for the people they represent. National Adoption Day National Adoption Day is a collective national effort to raise awareness of the children in foster care waiting to find permanent, loving families.   The Greater Prince William National Adoption Day celebration is scheduled for Saturday, November 19, 2005, beginning at 10:00 am, in PWC Circuit Court.  This is a collaborative event with the 31st Judicial Circuit Court, the City of Manassas, City of Manassas Park, and the Prince William County Departments of Social Services. This event will include the finalization of adoptions and the recognition of recent adoptions. Congratulations! The PWC Bar expresses sincere congratulations to Jim McCoart and his wife Karla and their daughter Eryn on the birth of their new daughter, Claire Elizabeth.  Claire was born on October 11th, weighing 8 1/2 pounds. Military Service Attorney Derek Poteet, with the law firm of Coon and Purnell, will be serving in Iraq with a platoon of military police whose primary responsibility will be convoy protection and check-point security. He goes active December 1st, 2005. Deployment is anticipated after January 1, 2006, and he will serve for 7 months from deployment.  Bar members wishing to offer support are encouraged to contact the firm. If other members of the bar are called into active duty to areas that place them in harm's way, please contact the bar office so we may alert the membership. The Pro bono Attorney of the Year Award-- Nominations Each year the Pro bono Committee seeks to determine whether and to whom to award the annual Pro bono Attorney of the Year Award.  This award was established to recognize, on behalf of the PWCBA, an individual who has made significant contributions to the community either by way of organizing/administering pro bono legal programs or by providing direct pro bono legal services. Nominations are now being accepted, and may be made either on the enclosed form or by typewritten letter, to Rusty von Keller, Chair, Pro bono Committee, 8567-D Sudley Road, Manassas, VA 20110.  The winner will be announced at the Annual Dinner Dance, which will be held on February 18, 2006. The following criteria will be used by the committee when considering nominees: y  Demonstrated dedication to the development and delivery of pro bono legal services in the Commonwealth of Virginia y  Contributed significantly toward the development of innovative approaches to the delivery of volunteer legal services y  Participated in an activity that resulted in satisfying previously unmet needs for legal services or in extending services to under-served segments of the population y  Successfully handled pro bono cases on behalf of the poor y  Devoted significant time to furthering the delivery of legal services to the poor in Virginia by handling pro bono matters The nominee must be a practicing member of the Prince William County Bar Association.  Persons whose livelihood is derived from delivering legal services to the poor are not eligible. Candidates' Forum Wrap-up The 2006 Candidates' Forum is over, and for the 85 people who attended, and for the thousands who saw the broadcast news coverage of the event on News Channel 8, or read about the forum in the Potomac News/Manassas Journal Messenger, it accomplished the primary goal:  We heightened community awareness of the election process.  The secondary goal was also achieved, that of helping to build bridges between the members of the PWC Bar and our Northern Virginia Delegation. The questions prepared by our distinguished panel were designed to focus the candidates on transportation, education and economic development related issues.  The audience submitted questions on a wide range of topics as well, and two of their questions were ultimately asked of the candidates in the final round.  Everyone stayed for the informal "meet and greet" following the onstage      portion of the forum, and feedback from all was positive.  The candidates, panelists, press, and attendees all appreciated the opportunity to either participate in or attend the event.  (We looked good!) The bar continues to look for ways to improve this bi-annual event.  Notable improvements for 2005 were the inclusion of a transportation specialist on the panel in lieu of a League of Woman Voters representative; securing volunteers from the PWC Bar to help the night of the event; and increased pre- and post- event publicity.  Areas for improvement for 2007 will include securing more volunteers; looking for alternative locations to host the event; and continuing to increase pre-event publicity with the hopes of increasing attendance, particularly by members of the PWC Bar. -6-
-7- Letter to the Editor Candidates Forum: An important opportunity missed. When the members of the Bar Association meet to vote to recommend judges to the General Assembly delegation, it is SRO, standing room only; a not-to-be missed event.  Our energy and interest are obvious, to us. Unfortunately, all but a few of us missed the opportunity at the Bar Association Candidates' Forum to show current and future members of the House of Delegates our energy and interest in the judicial appointment process and the many other issues which concern us as lawyers and as citizens.  We also missed the chance to demonstrate to our neighbors and other members of the community our interest, as members of the audience, with our questions and in conversation at the reception.  In earlier times, we lawyers led the community, with our participation, and our input on specific legislative issues was significant. Our abdication leaves a void. I was very proud of the quality of the Candidates' Forum and thank Tracy Hudson, Bob Cooper, Donna McIntosh, Alissa Hudson, and those others who produced this important event. Being there is important.  May we show our energy and interest in future forums, which assist the public and us in choosing our representatives. Elected representatives will remember that we cared about issues and will be there to listen to us. Sharon Pandak
